Qure – Terms of Service

1. Introduction & Acceptance
Welcome to Qure ("Qure", "we", "our", "us"). Qure operates a digital healthcare platform that enables users to connect with licensed healthcare professionals through online channels including WhatsApp, web, chat, and video.
By accessing or using our website, WhatsApp chatbot, or any related services (collectively, the "Services"), you:
- acknowledge that you have read and understood these Terms of Service ("Terms"), and
- agree to be bound by these Terms and our Privacy Policy.
If you do not agree, you must not use the Services.
2. Nature of Services & Role of Qure
- Qure is a technology platform, not a hospital, clinic, or medical practice.
- All medical advice, diagnosis, prescriptions, or treatment accessible through the Services are provided solely by independent, licensed healthcare professionals ("Healthcare Providers" / "RMPs") as per applicable laws and telemedicine guidelines.
- Qure:
- does not practice medicine or guarantee medical outcomes,
- does not control clinical decisions taken by Healthcare Providers,
- is not responsible for any professional acts, omissions, or negligence of Healthcare Providers.
3. Eligibility
To use the Services, you must:
- be at least 18 years old; or
- use the Services through, or with the valid consent of, a parent or legal guardian for minors; and
- have the legal capacity to enter into this agreement.
By using the Services, you represent that the above conditions are met.
4. Account Registration & Security
Certain features may require registration or identity verification.
You agree to:
- provide accurate, current, and complete information,
- maintain the confidentiality of OTPs, passwords, and access links,
- be responsible for all activities under your account / phone number,
- notify us promptly of any suspected unauthorized use or security breach.
We may refuse, suspend, or terminate access if information is false, misleading, or used abusively.
5. Telemedicine, Consent & Limitations
- By initiating a consultation or interacting through WhatsApp/our platform, you provide consent to receive teleconsultation and digital communication from Qure and Healthcare Providers.
- You understand that:
- telemedicine has inherent limitations compared to physical examination,
- a Healthcare Provider may advise in-person consultation if needed,
- not all conditions are suitable for remote care.
- Healthcare Providers are responsible for:
- verifying patient identity where appropriate,
- obtaining and recording consent as required,
- complying with applicable telemedicine and medical ethics guidelines.
6. Not for Emergencies
The Services are not intended for medical emergencies or life-threatening conditions.
If you experience symptoms such as (including but not limited to) chest pain, severe bleeding, difficulty breathing, sudden weakness, loss of consciousness, or any condition you believe is serious or life-threatening:
Immediately call your local emergency number or visit the nearest hospital.
Do not rely on Qure or WhatsApp messages for emergency care.
7. User Responsibilities
You agree to:
- provide accurate and honest health and personal information,
- use the Services only for lawful and legitimate healthcare purposes,
- not impersonate another person or misrepresent your identity,
- not harass, abuse, or threaten Healthcare Providers, staff, or other users,
- not attempt to disrupt, hack, reverse engineer, or misuse the platform,
- comply with all applicable laws and telemedicine norms.
We may suspend or terminate access for violations.
8. Healthcare Provider Responsibilities
Healthcare Providers using Qure agree to:
- hold and maintain valid registrations, licenses, and approvals,
- comply with relevant telemedicine guidelines, professional ethics, and applicable laws,
- ensure prescriptions and advice are appropriate for remote consultation,
- maintain confidentiality and proper record-keeping.
Healthcare Providers are solely responsible for the professional quality and legality of the care they provide.
9. Use of WhatsApp & Third-Party Services
- Qure uses approved business solutions (e.g., WhatsApp Business APIs, cloud telephony, payment gateways, video platforms) to deliver the Services.
- By interacting with our official WhatsApp numbers or integrated channels, you consent to:
- receiving messages related to appointments, reminders, payment links, and follow-ups,
- the processing of such communication by our service providers solely for delivering these Services.
- Third-party platforms have their own terms and privacy policies. Qure is not responsible for their outages or policy changes but uses reputable providers.
10. Fees, Payments & Refunds
- Fees for consultations or services will be communicated prior to payment.
- Payments are processed securely via third-party payment gateways; Qure does not store full card/UPI details.
- A refund or rescheduling may be provided in limited scenarios, such as:
- Healthcare Provider no-show,
- failure of Qure's systems preventing the consultation from taking place.
- Additional rules (if any) may be provided in a separate Refund/FAQ section. In case of inconsistency, those specific terms will prevail.
11. Privacy & Data Protection
Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, store, and protect personal data, including health information.
We aim to comply with applicable data protection and healthcare confidentiality laws. Please review the Privacy Policy carefully.
12. Intellectual Property
All content, branding, software, and materials on the Qure platform (excluding medical records and user-generated content) are owned by Qure or its licensors.
You may not copy, modify, distribute, or exploit any part of the Services except as expressly allowed by these Terms or with our prior written consent.
13. Prohibited Uses
You must not:
- use the Services for fraudulent insurance claims or illegal prescriptions,
- upload malware or attempt to gain unauthorized access,
- scrape or harvest data without authorization,
- use the platform to advertise or promote third-party services without permission.
14. Service Availability
We strive for reliable, secure Service, but:
- we do not guarantee uninterrupted or error-free operation,
- downtime may occur for maintenance, upgrades, or factors beyond our control.
We are not liable for delays/failures caused by telecoms, internet providers, infrastructure providers, or third-party platforms.
15. Limitation of Liability
To the maximum extent permitted by law:
- Qure is not liable for indirect, incidental, consequential, exemplary, or punitive damages arising from or related to use of the Services.
- Qure's aggregate liability for direct damages, if any, shall not exceed the total fees paid by you for the impacted service in the preceding 3 months.
Nothing in these Terms excludes or limits liability for gross negligence, wilful misconduct, or any liability that cannot be excluded under applicable law.
16. Indemnity
You agree to indemnify and hold harmless Qure and its officers, employees, and partners from any claims, losses, or liabilities arising out of:
- your misuse of the Services,
- your violation of these Terms or applicable laws,
- your interaction with Healthcare Providers, except where caused solely by Qure's own violation of law.
17. Termination
- You may stop using the Services at any time.
- We may suspend or terminate your access, with or without notice, if:
- you violate these Terms,
- your use poses risk, abuse, or legal exposure,
- we discontinue the Services.
After termination:
- your access to certain features may cease immediately,
- we may retain certain data as required by law or for legitimate business, medical, or legal purposes, as described in the Privacy Policy.
18. Governing Law & Jurisdiction
These Terms are governed by the laws of India.
Courts at Kerala, India shall have exclusive jurisdiction over any disputes arising out of or relating to these Terms or the Services.
19. Changes to Terms
We may update these Terms periodically. When we do:
- we will revise the "Last updated" date above, and
- your continued use of the Services after changes means you accept the updated Terms.
